Contested Divorce Cases in California

A divorce case begins with a Petition for a Dissolution of Marriage which is filed with the Superior Court. One of the spouses will file the Petition and the other spouse will become the Respondent. In a contested divorce, the parties involved are not able to agree on all of the divorce-related issues, such as child custody, child support, spousal support, property and debt division, payment of attorney fees and court costs. These issues will then have to be resolved through the courts. Furthermore, if there has been a domestic violence situation in the marriage, this issue will impact the divorce in such matters as child custody and visitation.

Several steps will be required in order to resolve this issue in a contested divorce. First of all, all of your property and assets will have to be distinguished as to whether they are marital or separate property. After this, the property will need to be appraised or valued. Then the courts can divide the marital property and assets as evenly as possible, taking into consideration all of the pertinent facts concerning the property and the case involved.

During any contested divorce trial which can take 6 months or more to resolve, you may need to obtain certain orders from the court, such as those for child support, spousal support, property possession, restraining orders, or move-out orders.
