Former divorce client testimonial:

"A Genuine Character Who Cares"

"Christine helped navigate me through the repercussions of a poor choice I made about a year and a half ago to enter into a marriage. Christine made the process clear to me and made herself available to take my oftentimes last-minute appointments. She clarified the outcome of my divorce and did so with ease and grace. I look up to Christine in a lot of ways, she asks poignant questions and time spent with her is always effective and rewarding. Christine is a genuine character who cares about her clients and I would recommend her to any of my colleagues and family in a heartbeat should they need professional advice or service from an attorney."

    Contested Divorce Cases in California

A divorce case begins with a Petition for a Dissolution of Marriage which is filed with the Superior Court. One of the spouses will file the Petition and the other spouse will become the Respondent. In a contested divorce, the parties involved are not able to agree on all of the divorce-related issues, such as child custody, child support, spousal support, property and debt division, payment of attorney fees and court costs. These issues will then have to be resolved through the courts. Furthermore, if there has been a domestic violence situation in the marriage, this issue will impact the divorce in such matters as child custody and visitation.

    Marital Property Division

In any divorce, you and your spouse will have to come to an agreement about the division of marital property and debts. If you do not agree on the details of this issue, it will be determined by the courts. California is a community property state, which means that the assets and property will be divided in as equal and fair a manner as possible.

Division of Assets and Debts in a Divorce

Several steps will be required in order to resolve this issue in a contested divorce. First of all, all of your property and assets will have to be distinguished as to whether they are marital or separate property. After this, the property will need to be appraised or valued. Then the courts can divide the marital property and assets as evenly as possible, taking into consideration all of the pertinent facts concerning the property and the case involved.

During any contested divorce trial which can take 6 months or more to resolve, you may need to obtain certain orders from the court, such as those for child support, spousal support, property possession, restraining orders, or move-out orders. Attorney Thielo will ensure that you are well represented in court and be your best advocate when these temporary orders are being made.

Attorney Thielo will work vigorously to help you settle any disagreements you may have with the opposing party concerning divorce related issues. If these issues cannot be settled outside of court, she will actively and aggressively represent you and your interests in the courtroom.
