Contested Divorce Cases in California

A divorce case begins with a Petition for a Dissolution of Marriage which is filed with the Superior Court. One of the spouses will file the Petition and the other spouse will become the Respondent. In a contested divorce, the parties involved are not able to agree on all of the divorce-related issues, such as child custody, child support, spousal support, property and debt division, payment of attorney fees and court costs. These issues will then have to be resolved through the courts.
