Guardianships
A legal guardianship consists of a court order which names you as the person who will be in charge of taking care of a child. A guardianship differs from adoption in that a guardianship does not replace parents. Parents may still be allowed to see their children, are expected to provide financial support, and may pass on inheritances and social security benefits to their children. Guardianships may last until a child turns 18 or may be terminated before that to return the child to the parents. Guardians may be grandparents, sisters, brothers, aunts, uncles, other relatives, foster parents, family friends, or someone else who knows the child. Guardians are often named in cases where there has been abuse or neglect in the child's home.
Adoption
In order for an adoption to take place, the parental rights of the birth parents must be terminated. This can be accomplished by the parents or through the courts. California law allows birth parents or the child's relatives to arrange a post-adoption agreement with adoptive parents. Such an agreement must be approved by the courts. Whether you are looking to adopt a child from the United States or from another country, the Upland family lawyer can help you with all of the legal steps required to obtain an adoption.
